Appeals/Post Conviction

If you or a family member has been found guilty of a criminal offense, there are several post conviction options you may want to explore in hopes of overturning that conviction and/or reducing whatever sentence was imposed. First, you may file an appeal. There are, however, strict time limits for filing an appeal so it is critical that you consult an attorney as soon as possible after a conviction in a criminal case.  In addition to an appeal, there are other avenues the Orlando criminal defense attorneys at Dicembre & Nace can investigate and pursue on your behalf, including Motion to Modify Sentence and/or Motion to Set Aside and Vacate Judgment and Sentence.

At the end of the day, every defendant is entitled to a fair trial and competent representation. That said, our criminal justice system, while the best, is still a system comprised of people. Judges, lawyers, police and juries are all human, which means they are all subject to making mistakes. Fortunately, we have a post conviction process that allows us to address those mistakes and errors when they occur.

If an error was made during the course of your case or trial, you may have grounds for an appeal. If you are successful with your appeal or request for post-conviction relief, your conviction may be overturned and you may receive a new trial a re-sentencing or, in some cases, outright release.
